Possibly because arson and assault are seen as deliberate, whereas a hit-and-run is not, and a hate crime enhancement cannot be levied unless intent/pre-meditation is shown. (That's a guess.)

@Bob Lai she is actually charged with attempted murder, in addition to whatever traffic stuff they would hit her with (maybe none, depending on how the state's laws are written, so she couldn't weasel out of criminal charges by pleading out to traffic).

IMHO, if Sarcone can't provide a simple explanation as to why a hate crime enhancement is not applicable, he's just as bad. His comment comes off as dismissive.
